		<![CDATA[<p>Doctors cannot remove all risks associated with childbirth, but they must be vigilant. If there are problems during labor and delivery, they must be prepared to respond appropriately. Yet sometimes they create or compound problems when they try to intervene too soon or in the wrong way.</p> <p>In Minnesota and across the nation, doctors must walk this fine line every day. And when they stray far from that line, the result can be gravely serious <a href="http://www.injuryattorneysmn.com/Practice-Areas/Medical-Malpractice/Birth-Injury.shtml" >birth injuries</a>.</p>]]>
		<![CDATA[<p>Just how well informed are women about the effects of invasive procedures like c-sections?&nbsp; A survey released last week by a nonprofit organization called Childbirth Connection sheds light on this question.</p> <p>The survey was of 2,400 women who had recently given birth.&nbsp; It identified several areas of concern regarding communication between doctors and pregnant women about medical choices.</p> <p>For starters, more than 2 of every 5 women surveyed experienced induced labor. Inducing labor typically involves oxycontin, a powerful narcotic drug.</p> <p>Whenever powerful drugs are used, there is inevitably a risk of harmful side effects. And yet about 1 in 4 of the women who had labor induced reported feeling pressured by doctors to submit to the procedure.</p> <p>To be sure, doctors may think they have good reasons for inducing labor. The pregnancy may have gone past due. Or, regardless of the due date, the baby might be becoming too large to fit well through the birth canal.</p> <p>But again, it is important that doctors explain to pregnant women that using oxycontin to induce labor does carry some risks. 		<![CDATA[<p>How common are medical mistakes? As we discussed last week, it is easy to focus too much on glaringly obvious errors, such as wrong-site surgery. To truly grasp the scope of the problem, however, it is necessary to understand the full scope of the problem of diagnostic errors.</p> <p>In Minnesota and throughout the nation, defenders of the medical profession typically try to minimize these mistakes by denying that they are truly harmful. But recent research has increasingly shown just how harmful diagnostic errors can be.</p>]]>
		<![CDATA[<p>A report sponsored by the Agency for Healthcare Research and Quality, a federal agency, looked at the severity of diagnostic errors that were reported anonymously by doctors themselves. The report found that more than 1 in every 4 of these mistakes was life-threatening, disabling or fatal.&nbsp;</p> <p>Another example of the severity of diagnostic errors came in a &ldquo;meta-analysis&rdquo; of the research literature on diagnostic errors. A meta-analysis is a sophisticated technique for summarizing and synthesizing the results of numerous separate studies.</p> <p>The meta-analysis on research into diagnostic errors concluded that the number of deaths from diagnostic mistakes in the U.S. each year is comparable to the number of deaths from breast cancer. That adds up to around 40,500 deaths every year due to diagnostic errors.</p> <p>One researcher, David Newman-Toker of John Hopkins, puts it bluntly. 		<![CDATA[<p>Wrong-site surgery does occur. And when it does, it's shocking - a nightmare that becomes reality. The same is true of prescription errors, such as when a nurse misreads an instruction and administers the wrong medication or the right medication in a drastically wrong dose. These images play on our fears like images from a horror movie.</p>
<p>Yet the type of medical malpractice that inflicts the most frequent and severe damage is something much less dramatic: diagnosis errors. In Minnesota and across the country, such errors account for the largest portion of malpractice awards paid out to injured people by medical care providers and their insurance companies.</p>]]>
		<![CDATA[<p>We know this due to a recent extensive study of malpractice awards conducted by Johns Hopkins Medical Center. Researchers looked at 25 years of data, from 1986 to 2010. They found that the amount of money paid out in malpractice claims for diagnostic errors was a whopping $38.8 billion during those years.</p>
<p>The most commonly known diagnostic error is probably failure to diagnose cancer. That type of medical error remains a major problem. And misdiagnosis is a serious problem as well.</p>
<p>In many cases, however, diagnostic error is harder to pin down than treatment errors are. If a doctor misses a diagnosis, there may be a considerable time lag before the full effects are felt. This is quite different than a treatment error, such as administering ten times too much of a medication because someone misread a zero on the dosage.</p>

		<![CDATA[<p>The words of the nurse spoke clearly, though no words could be sufficient. "This was a terrible mistake," she said, "and we are deeply sorry."</p>

<p>The nurse speaking was from Region's Hospital in St. Paul, where the remains of a stillborn baby were mistaken for laundry and sent to laundry service. The baby was a boy who was stillborn at 22 weeks.</p>

<p>A few days later, Region's officials admitted that a second stillborn baby's remains may have gone to a laundry service as well.</p>]]>
		<![CDATA[<p>Region's is a large, busy hospital. It delivers about 2,500 babies a year. Hospital officials said that there are about two stillborns a month.</p>

<p>To be sure, mishandling remains is not a direct act of medical negligence. Nor does the fact that a baby was stillborn necessarily imply a medical mistake during the delivery process.</p>

<p>But these two shocking incidents in Minnesota are also a reminder that the child birth process can be fraught with problems for both the mother and the child. For example, if the baby does not get enough oxygen during labor or delivery, the lack of oxygen can cause cerebral palsy.</p>

<p>Pregnancy complications can also occur when a fetus is not positioned to go through the birth canal properly. This type of problem often involves the baby's shoulder. It is a condition called shoulder dystocia (from a Latin word that means distress).</p>

<p>When this happens, it is an obstetrical emergency. But there are procedures that responsive doctors can often take to address it. Some of these are more drastic than others. But the point is that doctors and nurses must remain vigilant to the risk of complications during labor and delivery.</p>

		<![CDATA[<p>As humans, faces are key symbols that enable us to recognize each other. It is deeply hard-wired into our human DNA. The eyes, the nose, the mouth: each contributes to a unique picture of a unique person.</p>

<p>And yet, when we become medical patients, healthcare providers often start treating us as if were faceless. We get reduced to medical charts that summarize our medical symptoms or X-rays that seek to show certain parts of the body. This isn't merely dehumanizing. In Minnesota and across the country, it often results in misdiagnosis or other medical errors because one chart or X-ray looks so much like another.</p>]]>
		<![CDATA[<p>A new study has found, however, that when photographs of faces are included with their X-rays, the risk of doctors, nurses or radiologists mistaking one patient's test results for another's is reduced.  Indeed, the study found that misidentification errors declined by a factor of five when faces were included on X-rays.</p>

<p>The study's author, Dr. Srini Tridandapani, from Emory University School of Medicine, believes that a photograph should be added to every single medical-imaging study. It would help prevent misidentification errors that lead to misdiagnosis.</p>

<p>The practice of medicine is increasingly collaborative. Primary doctors and nurses must usually collaborate with many others to deliver good medical care. This makes communication with others, such as laboratory technicians, particularly important. Communication with specialists in specific fields of medicine is very important as well.</p>

<p>But in order for communication to be effective, all parties must be clear on which patient is which.</p>

		<![CDATA[<p>Robotic surgery has become, literally and figuratively, the cutting edge of innovation in surgical techniques. In the last few years, doctors have learned to work closely with robots, performing surgery in ways that only a few decades ago would have seemed like something out of a science fiction novel.</p>

<p>Instead of standing over a patient with a knife, surgeons who perform robotic surgery sit at a computer screen and operate a robotic device. Many of the surgeries performed this way have gone well. But in Minnesota and across the country, there is also concern about surgical errors in freak accidents. These errors put patients at risk of injuries and even death.</p>]]>
		<![CDATA[<p>The sheer number of surgeries done with robots now is strikingly large. Last year, there were about 367,000 surgeries performed with a robot named da Vinci. That was three times as many as were performed only four years ago.</p>

<p>The da Vinci device is used for numerous types of surgery. For example, it is often used to perform a hysterectomy, in which a woman's womb is removed. It is also used in gallbladder surgery and in surgery to remove prostates.</p>

<p>And that isn't all. The da Vinci robot is also used in organ transplants, as well as in gastric-bypass and other weight-loss surgery.</p>

<p>In short, the device has had an astonishing impact. But the downside is increasingly becoming known. The Food and Drug Administration is trying to determine why there has been such a spike in reported incidents in which patients have been harmed.</p>

<p>There have already been reports of five patient deaths linked to robotic surgery since the beginning of last year. One of those occurred during a hysterectomy when the surgeon-operated robot cut a blood vessel by accident.</p>

		<![CDATA[<p>Many doctors and pharmacists have been making concerted efforts in recent years to prevent medication errors. In Minnesota and across the country, the traditional system of a pharmacist trying to decipher a doctor's not-too-legible handwriting is increasingly giving way to sophisticated electronic delivery systems.</p>
<p>Those systems enable a doctor to choose the desired medication directly from a computer menu. The prescription is then transmitted directly to the pharmacy to be filled. Though such systems are from perfect, they have the potential to prevent many types of errors.</p>]]>
		<![CDATA[<p>But medication error is a broader term than prescription error. Even if a prescription is filled properly, it still has to be administered properly. And medical professionals still need better systems to safeguard that administration.</p>
<p>One of the challenges in doing so is the very pride that dedicated doctors and nurses take in their work. For highly skilled professionals such as these, it can be hard to admit that anyone can make mistakes that harm patients - even someone who truly cares about patients and is well known for paying attention on the job.</p>
<p>For example, a doctor of pharmacy recently wrote an incident in which a veteran nurse mistakenly injected a patient with the wrong medication. The nurse had meant to administer heparin. But she ended up administering insulin instead, after accidently picking up the wrong syringe.</p>
<p>The point is that to prevent medication errors effectively, hospitals and clinics need to be thinking beyond the actions of individuals. They need to design better systems so what similar syringes are not sitting so close to each other at the point of delivery.</p>

		<![CDATA[<p>Sometimes the best intentions backfire. That is why, in so many areas of human activity, it is important to use a pragmatic approach and make corrections when things don't do as planned.</p>
<p>A case in point is a new rule intended to improve patient safety by placing limits on the number of hours worked by young doctors who are in training. The purpose of the rule is clear enough: to prevent medical malpractice and improve patient outcomes by making sure medical residents are not overtired. Medical errors by fatigued doctors are a significant problem in Minnesota and across the country.</p>]]>
		<![CDATA[<p>To address this problem, in 2011 a board that oversees medical education reduced the guideline on the number of hours that young residents are allowed to work at one time without a break. The Accreditation Council for Graduate Medical Education revised the guideline down from 30 hours to 16. The thinking was that a sleepy doctor is more likely to make medical mistakes.</p>
<p>According to two recent research studies, however, the shorter shift has not really helped patients. In fact, researchers concluded that doctor errors that harm patients increased by 15 to 20 percent compared to residents who worked the longer, more traditional shifts.</p>
<p>It is not clear why errors increased. But one physicians not connected with the research suggested that a failure to adjust intern workload could be involved. If medical residents are expected to do the same amount of work in fewer hours, obviously that is a problem that can potentially put patients at increased risk of harm.</p>

		<![CDATA[<p>In the Civil Rights era, Dr. Martin Luther King warned of the "paralysis of analysis." It can be a problem when responsible decision makers fail to take strong corrective action on problems that have already been documented.</p>
<p>In the healthcare context, consider, for example, the problem of hand hygiene. For a hundred years, doctors and nurses have known that maintaining proper handwashing protocols is important to protecting patients from hospital-acquired infections.</p>
<p>And yet even today, many medical care providers fail to have programs in place to makes sure that this handwashing really does happen. Research can continue to document the problem. But truly solving the problem requires a common commitment by providers to make it happen.</p>
<p>This month, the well-respected Agency for Healthcare Quality and Research (AHRQ) came out with a new report on ways to better protect patients in hospitals. And improved hand hygiene was there on the list.</p>
<p>Hospitals would do a better job of addressing such problems, many experts believe, if they took a more comprehensive look at patient safety. Dr. Peter Pronovost of John Hopkins, in particular, thinks healthcare administrators should proactively address the need for organizational change to prioritize patient care - and not merely react to this or that aspect of it.</p>

		<![CDATA[<p>Cataract surgery is very common among older people. In the Minneapolis - St. Paul area and across the country, it's a procedure that virtually anyone of advancing age may face at some point.</p>
<p>You'd think, then, that medical practitioners would know how to do it properly. In a recent case in New Orleans, however, a man alleges that cataract removal surgery went terribly wrong. He says he woke up from anesthesia during the surgery - and then had his mouth covered with tape by medical staff after he asked them to stop the operation.</p>]]>
		<![CDATA[<p>The man further alleges that he lost vision in one of his eyes when the surgery was unsuccessful. And, to make the nightmare complete, he asserts that rough handling by staff caused one of his teeth to be knocked out - and that he swallowed it.</p>
<p>To be sure, this is an extreme case. But anesthesia errors are more common than one might think. According to one study, done in 2008, the national total for patients who wake up during surgery is around 30,000 per year.</p>
<p>What are the consequences of waking up during surgery? The effects on patients range widely. Some have only the briefest of memories of what happened. Others suffer genuine terror, however, along with a high level of pain, and may become temporarily immobilized. After such an experience, it is possible for someone to be plagued with post-traumatic stress disorder.</p>
<p>Of course, giving too strong a dose of anesthesia is potentially a problem too. After all, very strong chemicals are typically involved in administering anesthesia. That is why monitoring of a patient's condition during and after surgery is so important.</p>

The driver was a disabled war veteran driving  a handicapped vehicle with hand controls. The brake became stuck and  the veteran had to swerve around a few vehicles before he finally ended  up over the sidewalk, through the ditch and into the building. The  owner/operator of the agency just happened to not be at his desk at that  time, and is lucky. He could have been killed or severely hurt. The <a href="http://www.moundpolice.com/">Mound Police</a> confirmed the driver of the vehicle was taken to the hospital for  non-life threatening injuries. He sustained an injury to his leg.</p>

		<![CDATA[<p>Why, all of a sudden, are there roundabouts everywhere in Minnesota?</p>

<p>According the Minnesota Department of Transportation (MNDOT) website there are several advantages to using roundabouts at intersections that have high crash rates or where more than two roads come together. A National Highway Transportation Safety Administration (NHTSA) study reports that intersections changed to roundabouts show a 39 percent decrease in all crashes and an 89 percent decrease in fatal crashes.</p>

<p>Roundabouts can handle high levels of traffic without the delays of stop signs and stop lights. The tight curves of a roundabout slow traffic which makes everything flow more smoothly not to mention the fact that slower traffic can be a benefit for pedestrians.</p>

<p>MNDOT's website also has some tips for driving in a roundabout:</p>

<p>1.	When approaching a roundabout, slow down and get in the appropriate lane.<br />
2.	Yield to pedestrians in the crosswalk. They have the right of way.<br />
3.	When entering a roundabout, yield to vehicles already in the circle. Enter the traffic flow when it is safe.<br />
4.	Continue through the roundabout until you reach your exit. Do not stop, pass vehicles or change lanes in a roundabout.<br />
5.	If an emergency vehicle approaches, exit immediately and then pull over and stop. Do not stop in the roundabout.<br />
6.	When exiting the roundabout, signal your turn and yield to pedestrians in the crosswalk.</p>

<p>In Eagan, MN, where Bennerotte &amp; Associates is located, there is a roundabout that I drive through a few times a week. In my opinion it does make traffic flow better and avoids a four-way stop and having to figure out whose turn it is to go next. I do think, however, that a roundabout can be confusing for some drivers which may lead to minor vehicle crashes.</p>

		<![CDATA[<p>State Fire Marshal, Jerry Rosendahl, said that the deadly fire in Mora last week that claimed three lives is being considered accidental. It appears to have started in the living room in one of the basement apartments but it will be a while for the exact cause of the blaze is determined.<br />
Rosendahl also said that the hard-wired smoke detectors in each of the four apartments in the building were not functioning when the blaze occurred and although each apartment had a battery operated smoke detector, only one of the four was working at the time of the blaze.<br />
The property owners would have been required by law to have hard-wired smoke detectors in every apartment if it had electrical upgrading in recent years. Rosendahl says that operational smoke alarms "are a consistent, predictable contributor to survival in structure fires." The property owners would not comment when asked about the inoperable smoke alarms.<br />
The outcome of this fire was tragic but may have been preventable if the smoke alarms were functioning properly. 		<![CDATA[<p>A new study conducted by the National Highway Transportation Safety Administration has found that text messaging while driving has jumped 50% since last year despite federal and state campaigns to make drivers aware of the dangers of texting and driving.</p>

<p>To get the information for the study researchers monitored stop lights and intersections to count the number of drivers who were focusing more on their phones than on the traffic around them. The researchers found that 1% of motorists were focusing on their phones. While historically texting and driving was more prevalent amongst younger drivers the study found that older drivers are now texting more.</p>

<p>The study also discovered that many drivers are willing to answer a call and even text while driving but those same drivers stated that they would feel very unsafe as a passenger if the driver was talking on the phone or texting.</p>

<p>In Minnesota drivers under 18 aren't allowed to be on the phone at all while driving but since the state made texting and driving illegal in 2008 troopers have issued more than 900 tickets and about as many warnings. It is also illegal for all drivers in Minnesota to text while driving.</p>
