Failure to Diagnose Cancer

FAILURE TO DIAGNOSE CANCER LAWSUIT IN MINNESOTA

Failure to diagnose cancer is a very serious matter when it means that a cancer patient has lost the opportunity to get timely, lifesaving treatment. Bennerotte & Associates, P.A., can evaluate your potential medical malpractice claim if your doctor, diagnostic lab, or other medical provider failed to diagnose and/or treat any of the following types of cancer in a timely manner:

  • Breast cancer
  • Lung cancer
  • Leukemia
  • Cancer of the colon

In the heartbreaking case of Jocelyn Dickhoff, who died in the summer of 2013, her mother had initially brought a tumor to the attention of her doctor. The doctor's failure to act resulted in a lost chance for Jocelyn.

CANCER MISDIAGNOSIS — MINNESOTA LAW NOW ALLOWS "LOST CHANCE" AS A CAUSE OF ACTION IN A LAWSUIT

The Minnesota Supreme Court issued an opinion explaining that the patient's lost chance to try early, promising treatments was a loss of value in itself: "When a physician's negligence diminishes or destroys a patient's chance of survival, the patient has suffered real injury. The patient has lost something of great value; a chance to survive, to be cured, or otherwise to achieve a more favorable medical outcome. Accordingly, we conclude that a physician harms a patient by negligently depriving her of a chance of recovery or survival and should be liable for the value of that lost chance."

Jocelyn's case is noteworthy. It may or may not be relevant to your medical malpractice claim. However, it is worth your while to discuss your own experiences regarding a doctor's failure to diagnose cancer with one of our lawyers. We can help determine whether you have a case after a doctor failed you by not investigating or diagnosing cancer in a timely manner.
