Proving the other driver was at fault comes in a variety of different you will. You do it in a number of different ways, but I think the most important one with trying to prove that unless it’s obvious, you know, a rear end collision is fairly obvious, but can always be a contention that, you know, you slammed on your brake. So even that can be contested, or maybe there’s weather involved. I think the biggest thing about proving the other drivers at fault, and what’s most important, is trying to get to me early, get to the point where I can get involved and start to investigate quickly, because the faster I can get the information, the facts, you know, skid marks, witnesses, other things like that, the easier it’s going to be to establish fault in the other party.

You know, some things are simple, some things are much more difficult, but the faster you can get the evidence. Maybe get an accident reconstructionist out, maybe get a download on the electronic data out of a vehicle to prove speed, or things like that. Those are all key, key elements, and the earlier you do it, the more likely you’re going to be to prove fault, because the evidence is going to be more accessible. It’s going to be people will have a better memory of it, and doing that right away is going to be far easier than doing it as you get down the road where some people think they can do it on their own, which plenty people out there that are bright enough to do that, but when they let key pieces of evidence maybe drop by the wayside or key witnesses disappear, those all become very problematic so early and trying to find anything and everything you can. So a lot of it comes back to experience. 

I’ve done this a long time. We all get smarter the more we do anything in life, but get to me early, let me figure out what happened, and if there’s any way to prove fault, we’ll be able to do it in that setting.
