What makes truck accident claims more complex?

Truck Accident Claims are more complex, and one of the biggest reasons is is because the trucking companies defend their claims against them very zealously. They’re going to do whatever they can to try to fight so what they do is they’re going to have people out at the scene after a crash happens with a truck. They’re going to get out, they’re going to do downloads on information, and they’re going to start to do whatever they can, but as fast as you can think to start figuring out how they’re going to defend the claims. It’s very important with truck accident cases to get in for us to get involved early. We need to get the right experts in place. We need to get the right evidence. We want to try to get all the information as early as possible, because the earlier we can get the information and start to set up how we’re going to pursue the claim, how we’re going to figure out, are there violations here? Did the trucking company? Because trucking companies are required to follow the fair motor carrier safety regulations, you know, did they follow what happened? And then it’s going even a step further, where then I’m trying to figure out, Okay, I’m going to try to get on the truck driver’s Facebook page and see if I can find anything there. 

We just had a case where we were able to get on early phone all kinds of damning evidence against the truck driver, where he had been videotaping while he’s going down the road driving things that made him look bad. Then it was going steps further, and hiring an investigation company to get out and talk to former employees of the trucking company to figure out, okay, we know what they did wrong here. Can we find out from as many former employees as possible if we have similar issues in the past, so that we know that they failed to do anything about them. And then it just goes from there you’re looking at, you know, get a reconstruction this out to the scene. Try to lock down who’s at fault. 

Another case we had recently, it looked as if fault was completely against the decedent. The family had retained us in a wrongful death case. When we really got out there and went to looking further, it was much the opposite, but it took a very experienced national reconstruction expert to help get out to the scene and look. And as he said, it’s not always the evidence you have. Sometimes it’s the evidence you don’t have. And in that case, the evidence we didn’t have is what proved to be very, very helpful to us. And let us prove liability on the other party. After that Reconstructionist got out there and saw things that an expert would it totally changed the direction of the case. The other side didn’t even fight on fault anymore. So truck accident cases, complexity is huge. Getting the information early is huge, but knowing that the trucking company is going to do everything they can to fight back requires that you get to somebody skilled early. 

But you don’t just hire for a trucking case, hiring just Joe Blow car accident attorney. No offense to those folks, but truck accidents are much different than car accidents, and they have to be handled as such if you want to get the result that you desire as the injured person, and not just have somebody that handles day to day car crashes doing it.
