Minnesota’s No-Fault Auto Insurance System
Minnesota is a no-fault state under Minnesota Statutes Chapter 65B. After a car accident, your own Personal Injury Protection coverage pays your initial medical bills and a portion of lost wages, no matter who caused the crash. But serious injuries—those that meet Minnesota’s tort threshold—allow you to step outside the no-fault system and bring a direct liability claim against the at-fault driver for pain and suffering and other damages not covered by PIP. Knowing when that threshold is met, and moving quickly when it is, directly affects what you’re able to recover.
Modified Comparative Fault
Under Minnesota Statutes Section 604.01, you can still recover damages if you were partially at fault, as long as your share of fault doesn’t exceed 50%. Your recovery is reduced by your percentage. So if you were 20% at fault and your damages total $200,000, you’d recover $160,000. Insurance companies push hard to inflate the victim’s fault percentage. It’s one of the oldest tactics in the playbook, and it’s exactly why having an attorney matters.
Dog Bite Strict Liability
