What should I do if I’m hit by a car while walking?

A lot of times when we see people that are hit by a car walking, it will be at a — we’ll say maybe at the grocery store, in a mall parking lot, maybe a convenience store. You know, more often than not, they happen in parking lots. And I think the biggest thing that’s tricky there is this. Cops don’t typically come and investigate and write reports when you get injured on what they’re going to call private property. And the old adage they will often use, whether it’s to try to duck responsibility in doing their jobs or otherwise, is, you know, the rules of the road don’t apply.

Well, I guess maybe they can use that theory. We would beg to differ. And even if you argue rules of the road don’t apply, if you get hit by a car in a parking lot, the fact of the matter is we still know what proper etiquette — what a reasonable driver will do — in those circumstances. And the one thing they won’t do is run into people. So, it can be maybe backing up. Sometimes it’s just pulling out of a parking lot where they’re looking somewhere else, not looking ahead of them. Those happen often.

And the first thing that you’re going to want to do is — again, often tricky when you’re the injured person — see if there’s witnesses around. But then the other — it’s very common, but it takes some some assistance to do — is try to get the videos that often are at those sorts of establishments. Convenience stores almost always have them. Malls almost have them. Always have them. Grocery stores could be your local Walmart or Target or wherever. You’re in the parking lot. Somebody runs into you because they’re distracted — maybe looking at their phone, maybe looking at something else, maybe looking at their pet in the car or their kid. But trying to obtain that information early on to help establish what really occurred through the video. Those videos can be hard to get, and they do tape over them quickly.
